Once the Judge releases you from the bond obligation, refunds are generally processed on the day of your court appearance. Cash refunds on bonds are not permitted at the Clerk's window.
What is a Court of Record?
A Court of Record is a court in which trial proceedings are recorded upon request.
Why would a Municipal Court become a Court of Record?
Several reasons for a municipal court to become a court of record include:
-
To reduce the number of uncontested cases being appealed
-
To reduce the administrative burden of trials de novo at the county
-
To provide a uniform trial process
-
To provide for trial court proceedings on a record if requested
-
To prevent loss of potential fine revenue; (In a trial de novo, fines assessed remain with the county; in a court of record, fines assessed will remain with the municipality)
-
To reduce Police overtime and expenses when officers are subpoenaed to testify in trial de novo cases.
How much does it cost to appeal a case from a Court of Record?
-
The defendant shall pay the $25.00 fee for preparation of the clerk’s record.
-
The defendant shall also pay the fee for an actual transcript of the trial proceedings. That amount may vary depending on the length of the trial and the number of pages included in the transcription.
-
The appeal bond is either $100.00 or double the amount of the fine and costs assessed at the trial, whichever is greater.
